By downloading, installing, or using EverGlow ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
EverGlow is a mobile application that allows you to create and manage countdown and count-up timers for personal events. The App offers both free and premium features available through an auto-renewable subscription.
3. Subscriptions and Payments
Free Features
EverGlow provides basic functionality for free, including the ability to create up to 2 countdown or count-up events.
Premium Subscription
- EverGlow Premium is available as a monthly auto-renewable subscription.
- Premium unlocks unlimited events, custom background images, advanced notifications, and sharing features.
- The subscription price is displayed on the purchase screen before you subscribe.
Billing and Renewal
- Payment will be charged to your Apple ID account at confirmation of purchase.
- Your subscription automatically renews each month unless auto-renew is turned off at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
- You can manage and cancel your subscriptions by going to your Account Settings in the App Store after purchase.
Free Trial
If a free trial is offered, any unused portion of the free trial period will be forfeited when you purchase a subscription, where applicable.
4. User Content
You retain ownership of all content you create within the App, including event names, dates, and images. All user content is stored locally on your device and is not transmitted to our servers.
5. Acceptable Use
You agree to use the App only for its intended purpose — creating and managing personal event timers. You agree not to:
- Reverse engineer, decompile, or disassemble the App
- Attempt to gain unauthorized access to any part of the App
- Use the App for any unlawful purpose
- Redistribute, sublicense, or resell the App
6. Intellectual Property
The App, including its design, code, graphics, and branding, is owned by EverGlow and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
7. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we handle your information. By using the App, you consent to our privacy practices as described in the Privacy Policy.
8. Disclaimers
- The App is provided "as is" without warranties of any kind, either express or implied.
- We do not guarantee that the App will be error-free or uninterrupted.
- We are not responsible for any data loss resulting from device failure, app uninstallation, or other circumstances, as all data is stored locally on your device.
9. Limitation of Liability
To the maximum extent permitted by law, EverGlow and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.
10. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective when posted within the App or on our website. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
11. Termination
We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the App.
12. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
